The head coach of the Spain women’s team says she was unaware a sexual violence protocol existed at the Spanish football federation after Luis Rubiales kissed Jenni Hermoso at the 2023 World Cup final.
Montse Tome, who was assistant head coach to Jorge Vilda as Spain won that World Cup 18 months ago, appeared as a witness on Monday at the Audencia Nacional court in Madrid during Rubiales’ continuing trial for alleged sexual assault and coercion. She was called as a witness by the defence.
Rubiales, former president of the Spanish football federation (RFEF), kissed Hermoso as she and her team-mates received their winners’ medals and the trophy on the pitch in Sydney on August 20, 2023 following a 1-0 win against England. He maintains the kiss was consensual.
The prosecution alleges that Rubiales, 47, and three other RFEF employees — Vilda, the former Newcastle United forward and ex-RFEF sporting director Albert Luque and then marketing director Ruben Rivera — coerced Hermoso into publicly supporting Rubiales’ version that the kiss had been consensual. Rubiales, Luque, Rivera and Vilda deny any wrongdoing.
Asked by Maria Jose Lopez, the lawyer representing the Spanish players’ union (AFE), whether she knew there was a sexual violence protocol in place at the RFEF “to protect women especially”. Tome said: “I’ve never spoken with anyone in the federation about that.”
When pressed by Lopez if she knew, while holding the second most senior role with the Spain team at a World Cup, about the safeguarding protocol, Tome said she did not.
Five days after the kiss, on August 25, Rubiales gave his infamous “I will not resign” speech while chairing an extraordinary RFEF assembly.
The next day, August 26, Tome and 10 other members of the Spain women’s coaching staff published a collective statement condemning the “unacceptable attitudes and actions of the RFEF chief” in which they said they had been “obliged to attend the assembly”. They also offered their resignations. In court, Tome said that statement was to show “we were totally against the events that happened and that we positioned ourselves with the players”.
AFE lawyer Lopez highlighted that Tome and the others still did not activate the sexual violence protocol, however. That didn’t happen until August 27, seven days after the final, following a complaint by another party.
In the most recent version of the protocol published by the RFEF in June 2023, two months before the incident in Sydney, it lists “kissing by force” as one of the “situations, attitudes and behaviours related to sexual violence”. It says the RFEF should designate a “protection delegate” who leads the strategy of protecting sportspeople.
An investigation was started by the RFEF’s protection delegate, Maria Dolores Martinez Madrona, who is also a referee in Spain. The RFEF protocol says the investigation would involve speaking with the parties involved, as well as witnesses, to gather information on the incident.
In more serious cases, the protection delegate will put together a report which will be elevated to the RFEF’s advisory committee, who will then raise it with the body’s presidency. So at the time (until his resignation on September 5) that would have been Rubiales himself.
The RFEF says a report was produced by the integrity department, which was then submitted to the compliance team. The investigation was paused when criminal proceedings began against Rubiales and the report was shared with the court.
Rubiales was replaced as RFEF president by Pedro Rocha, though the latter subsequently got suspended for two years in July 2024 after Spain’s superior sports court (TAD) deemed the dismissal of former general secretary Andreu Camps in September 2023 was an abuse of his authority. Rubiales had handpicked Rocha as his successor.
In December last year, Rafael Louzan was elected RFEF president, and earlier this month he was cleared of misusing public funds following an appeal, which allows him to remain in office.
Another line in the RFEF sexual violence protocol says it will “seek the protection of the victim and/or the person who asked for help, guaranteeing that reprisals aren’t produced against the persons who presented the request, testify or participate in the process”.
Throughout this process, including when she testified on day one of the trial, Hermoso has spoken of the isolation she has felt and the lack of protection given to her by the RFEF. On day one, she said nobody from the RFEF came to see her to see how she was: “I felt completely unprotected by the RFEF. It was supposed to be my safe haven, I was a football player for their country. And no one asked me. They just came to save their reputation.”
“I felt absolutely alone at all times,” she said later. “Whoever could have done a little more and helped me on the spot, which was the RFEF, did not do so and made me feel totally alone.”
When Vilda was fired as head coach of the women’s team, also on September 5, 2023, Tome was promoted to replace him. She did not pick Hermoso, Spain’s record goalscorer, for her first matches in charge against Sweden and Switzerland later that month. Hermoso was recalled and helped Spain win the Nations League in February last year, but there was another controversy in November when Hermoso, Irene Paredes and goalkeeper Misa Rodriguez were dropped from the national squad, despite being chosen as captains by their team-mates. Hermoso has not played for Spain since October.
Speaking on Monday, Tome said: “What I said in the investigation phase a year ago, I refer to all that, because it’s what I think, it’s what I felt and what I feel. What I said: the reasons for which Jenni didn’t come to the first call-up were sporting, I’ve said it.
“And protecting her came into that because of the situation we were experiencing, which was an exceptional situation and we were protecting her from the media. But of course, everything, everything is an absolutely sporting decision.”
When asked by the AFE lawyer if leaving Hermoso out after the World Cup was a punishment, Tome said “it wasn’t a punishment, not a punishment at all”.
Rubiales will give evidence tomorrow, February 11.
